For a Delhi resident, a Will is the legal declaration of how you want your assets distributed after your death. Section 2(h) of the Indian Succession Act 1925 defines it as the testator's declaration of intention with respect to property, to be carried into effect after death.
Without a Will, default succession law decides for your Delhi assets the same way it would anywhere in India. To make a valid Will you must be of sound mind, not a minor, and signing voluntarily (Section 59). Two independent witnesses must be present at signing (Section 63). These two conditions are the only legal essentials, notarisation and registration are optional additions on top.
Every one of the six Will types is available in Delhi, explained in full on this page.
Signed before a Notary Public rather than filed at the Sub-Registrar. Wet-ink signed for authenticity, without any government filing involved. It is the quicker, lower-cost way to add a layer of authenticity to your Will, with no Sub-Registrar visit needed at all.
Notaries appointed for Delhi practise across the NCT, so attestation can usually be arranged close to where you live.
Filed at the District Sub-Registrar Office for your area of residence, under Section 18 of the Registration Act 1908. Registration is optional, but a registered Will is presumed authentic in law, making it far harder for a relative to successfully challenge later.
In Delhi this happens at the Sub-Registrar Office for your revenue district, with the slot booked through the Delhi Revenue Department portal.
An Advance Medical Directive under Common Cause vs Union of India (2018, modified 2023). It records your end-of-life medical treatment wishes, not who inherits your assets, resting on the Article 21 right to die with dignity. It sits alongside your asset Will rather than replacing it.
Delhi families frequently pair this with a Registered Will so that both health and property wishes are on record together.
Covers your Indian assets in Delhi specifically, using a Primary Will (India) and Ancillary Will (foreign country) strategy, each worded to reference the other so neither revokes the other.
A large share of NRI enquiries involve inherited Delhi property still standing in a parent’s name.

A single Will executed by both spouses together, addressing jointly and individually held assets. Registered at the District Sub-Registrar Office for your area of residence for the same fee as an individual Registered Will, with both of you and two witnesses present.

Registering a Will in Delhi is separate from property registration. A Will does not attract stamp duty because it does not transfer ownership of any asset at the time of registration. It takes effect only after the testator’s death.
The government charges a modest registration fee, which is much lower than the costs associated with registering a property. Government fees can change from time to time, so we verify the applicable fee before your appointment.
With AasaanWill, you don’t have to worry about calculating or paying this separately. Our fee for Will drafting and registration includes the applicable government registration fee, so you know the total cost upfront.
Delhi is divided into 11 revenue districts. Each has a Sub-Registrar Office, and the office you attend is decided by where you live, not by where your property sits. Appointments are booked online through the Delhi Revenue Department portal before you go.
Will registration under Section 18 of the Registration Act, 1908 is voluntary, and the government registration fee is nominal—far lower than the costs involved in property registration. Fees are set by each state or Union Territory and may be revised from time to time.
With AasaanWill, the applicable government registration fee is included in the total fee you pay for our Will drafting and registration service. We confirm the current government fee before your appointment, so there are no surprises about the cost.
