Section 2(h) of the Indian Succession Act 1925 defines a Will as a testator's written declaration of intent for their property, which only takes effect after death, the same law that applies whether you are in Kolkata, Delhi, or anywhere else in the country. Where Kolkata differs is downstream, in the specific way West Bengal's registration offices are organised, with a Registrar of Assurances holding wider powers than an ordinary Sub-Registrar.
Without a Will, your Kolkata assets pass under the succession law that applies to your religion rather than your own wishes. A Will only becomes legally valid through two things: soundness of mind and a voluntary signature (Section 59), witnessed by two independent people (Section 63). Notarisation and registration go further still, and registration in particular is strongly recommended for anyone with property or assets specific to Kolkata, since it puts the Will permanently on record with the state.
You can execute any of these six in Kolkata, so it's a matter of picking the one that fits your family.
A Notarised Will is a Will that a Notary Public has witnessed and stamped in person, confirming your identity and signature outside any government filing system. In Kolkata this route works well for families who want authenticity fast without going through the Registrar of Assurances or a District Sub-Registrar.
Notaries practising across Kolkata can usually attest close to your neighbourhood.
A Registered Will is a Will filed under Section 18 of the Registration Act 1908, with the government keeping a permanent copy on its own record. In Kolkata this can go through either a District Sub-Registrar or the Registrar of Assurances, and we recommend it for most families for the strength it adds if the Will is ever contested.
Kolkata's Registrar of Assurances has a wider mandate than an ordinary Sub-Registrar, since the office can register documents relating to property anywhere in West Bengal.
Legally, this falls under Common Cause vs Union of India (2018, procedure simplified 2023) and is known as an Advance Medical Directive. Unlike an asset Will, it makes no statement about property, it only sets out the medical treatment you would or would not want in a situation where you cannot express your wishes.
In Kolkata, this is frequently drafted alongside a Registered Will, so nothing is left unsettled on either front.
Built specifically for your Kolkata assets, split into a Primary Will covering India and an Ancillary Will for wherever else you live, with each document referring back to the other so neither cancels the other out by mistake.
A large share of our Kolkata NRI cases involve ancestral property in North Kolkata, still standing in a parent's name.
Made for the more layered estate, several properties, a business, trusts, assets outside India, or a blended family that needs the wording handled with care. A doorstep visit and priority attention come on top of whichever structure above applies.

Husband and wife sign the same Will, which covers both what you hold jointly and what belongs to each of you individually. Registration is priced the same as a single person's Will, and both spouses need to be present with two witnesses.

This has nothing to do with property registration, despite the two often being mixed up. A Will carries no stamp duty at all, since it transfers nothing the day it's registered, taking effect only once you pass away.
The registration fee in West Bengal is a small flat amount, and it varies as per the latest rules set by the Directorate of Registration and Stamp Revenue. West Bengal's registration structure is organised into 12 ranges, each headed by a Deputy Inspector General of Registration, with Kolkata's own Registrar of Assurances holding a wider mandate than an ordinary District Sub-Registrar. We confirm the exact fee for your case before booking.
Kolkata's registration offices sit under the Registrar of Assurances, an officer with the authority to register documents relating to property anywhere in West Bengal, alongside the ordinary Additional District Sub-Registrar offices spread across the city. The office you attend depends on where you live.
Your Will is drafted to the Indian Succession Act 1925, with a clear executor and asset schedule.
We confirm whether your case falls under a District Sub-Registrar or the Registrar of Assurances, and book your appointment accordingly.
You and two witnesses, none of whom benefit under the Will, attend in person with identity documents and photographs.
The registering officer verifies your identity, confirms the Will is yours and made voluntarily, then records it in the official register.

No. Section 18 of the Registration Act 1908 makes Will registration voluntary throughout India, West Bengal included. A Will is legally valid once the testator signs it and two independent witnesses attest it under Section 63 of the Indian Succession Act 1925, whether or not it is later registered.
