What a Power of Attorney does for a Pune family

In Pune, a Power of Attorney is the written instrument through which a Principal appoints an Agent to act for them while the Principal is alive. Section 1A of the Powers of Attorney Act 1882 defines the term, and the agency provisions of Chapter X of the Indian Contract Act 1872 govern the relationship. A Power of Attorney does not transfer ownership

Ownership does not travel through a PoA. That has been the Supreme Court's position since Suraj Lamp (2011): the Agent signs the transfer documents, and title to a Pune property passes only through the registered Sale Deed or Gift Deed itself.

The eight clauses of a Pune Power of Attorney

Eight clauses go into every PoA we draft for Pune. They are the reason the deed is accepted at the bank and at the Haveli counter.

1. Parties and Identification

The Principal and the Agent, named exactly as their identity documents read, with addresses and ID references. Pune counters return deeds over a single mismatched initial.

2. Recitals

One or two sentences on why the PoA is being given, so the bank officer or registrar does not have to infer the purpose.

3. Powers Granted

The list everything else depends on: each power set out separately, with the specific account, the specific Pune property, and the specific authority.

5. Duration and Termination

When the authority begins, when it ends, and which events end it early.

6. Durability

7. Revocation Mechanism

Stamping & Registration

Start with registration, because it is the question most Pune families get wrong. Section 17 of the Registration Act 1908 makes registration compulsory the moment a PoA allows the Agent to sell, mortgage, lease long-term, or otherwise deal in immovable property. Without it, those property powers are not enforceable. A PoA confined to banking, court appearances, or company matters does not need the Sub-Registrar; notarisation is enough.

Stamping applies either way. In Pune the PoA is stamped under the Maharashtra Stamp Act, and what the state charges turns on the powers granted and on whether the Agent is a close relative.
