The Basics

What a Power of Attorney in Hyderabad covers

In Hyderabad, a Power of Attorney is the instrument by which a Principal appoints an Agent to act on their behalf during the Principal's lifetime. Section 1A of the Powers of Attorney Act 1882 defines it, and Chapter X of the Indian Contract Act 1872 supplies the agency rules that govern it. For a Hyderabad resident the scope can be a single act or the whole of their affairs.

For a Hyderabad family the document usually does one of two things. It gives one person a single job, such as completing a flat sale at the Sub-Registrar, or it lets one person manage a set of affairs, from the bank to the GHMC office, for a parent who wants to step back from the errands. The wording has to match the job: authority stated too loosely is refused at the counter, and authority stated too widely invites misuse. A Power of Attorney does not transfer ownership

A PoA is not a route to ownership. The Supreme Court made that clear in Suraj Lamp (2011): the Agent may sign the transfer documents, but title to a Hyderabad property passes only through the registered Sale Deed or Gift Deed, never through the PoA.

1. Parties and Identification

Who is giving the authority and who is receiving it, with names, addresses, and ID references copied exactly from the identity documents. A one-letter mismatch is enough for a Hyderabad counter to return the deed.

2. Recitals

The reason the PoA exists, stated in a sentence or two, so the reader at the bank or the registrar is not left to guess.

3. Powers Granted

The list the whole deed turns on: every power, one by one, with the specific account, the specific Hyderabad property, the specific authority named.

Does the authority survive the Principal's incapacity, or not? The deed answers this expressly, because silence defaults to the outcome families least want.

7. Revocation Mechanism

Stamping & Registration

Stamp duty and registration for a Power of Attorney in Hyderabad

A Power of Attorney in Hyderabad is a stamped instrument under the Indian Stamp Act 1899 as it applies in Telangana, which sets it apart from a Will. The duty depends on the scope of authority granted and on the relationship between Principal and Agent; a narrow SPA to a family member and a broad property PoA to an outsider are treated differently. Telangana revises its schedule from time to time, so we confirm the exact figure for your case during the consultation, before drafting.

Whether registration is needed depends on the powers. If the PoA lets the Agent sell, mortgage, lease long-term, or otherwise deal in Hyderabad property, Section 17 of the Registration Act 1908 requires registration, and without it those powers have no legal effect. In Telangana the slot at the Sub-Registrar is booked online through the IGRS Telangana portal, which is mandatory, and the e-stamp is purchased in advance.
